General Terms and Conditions for the yooy Creator Program

1. Participation

By joining the yooy Creator Program, you agree to participate in the program in accordance with these Terms and Conditions and to be bound by them.

If you do not fully agree to these Terms and Conditions, you are not entitled to register for or participate in the yooy Creator Program in any way.

Participation in the program is at yooy’s sole discretion. There is no entitlement to acceptance, and yooy reserves the right to reject applications without stating any reasons.

2. Benefits Provided by yooy

Once your application has been approved, you will receive:

  • 50% off one individually configured pair of yooy glasses. This discount code may be redeemed once only. Details regarding its validity and redemption will be provided together with the code.
  • A personal discount code for your community.
  • A 15% commission on every successfully referred order.

yooy reserves the right to amend its discount and commission structure at any time with effect for future orders. You will, of course, be informed of any changes in advance.

3. Creator Responsibilities

By redeeming the Creator discount, you agree to:

  • publish at least one Instagram Story or a comparable social media post;
  • present your yooy glasses in a positive and authentic manner;
  • tag yooy, where technically possible; and
  • comply with all applicable advertising disclosure and sponsorship regulations.

The required content must be published within 30 days of receiving your glasses.

4. Discount Codes and Commissions

Each Creator receives a unique personal discount code.

Customers using this code receive a 10% discount on their purchase.

For every completed order placed using the Creator’s personal discount code, the Creator will receive a commission of 15% of the net sales value.

Example: For a pair of glasses sold in Austria at €449, the commission is approximately €50.

Commissions become payable only after the customer’s order has been paid in full.

No commission is payable for cancelled, withdrawn, or refunded orders.

5. Commission Payments

Commissions are calculated as of the last day of each calendar month and paid to the Creator’s nominated bank account during the following month.

yooy reserves the right to offset outstanding claims against any commission payments.

6. Rights of Use

The Creator grants yooy a non-exclusive, worldwide, perpetual, royalty-free licence to use any content published in connection with yooy for its own marketing and communication purposes.

This includes, in particular:

  • the yooy website;
  • social media channels;
  • presentations; and
  • advertising and promotional materials.

The Creator retains all copyright and other intellectual property rights in their content.

7. Termination

The Creator may terminate participation in the program at any time by providing written notice via info@yooy.design.

yooy may remove any participant from the program at any time and without stating any reasons.

Any commission earned up to the effective date of termination shall remain unaffected.

8. Prohibited Activities

To protect the integrity of the yooy Creator Program, the following activities are prohibited:

  • sending spam, unsolicited messages, or misleading communications;
  • falsely representing your relationship with yooy or creating the impression that you are an official representative of yooy;
  • publishing unlawful, discriminatory, offensive, or otherwise inappropriate content;
  • using fraudulent methods to generate commissions;
  • operating multiple accounts to circumvent these Terms and Conditions; and
  • distributing discount codes or affiliate links through coupon, cashback, or discount websites.

9. Paid Advertising and Traffic Diversion

The Creator agrees in particular:

  • not to bid on yooy’s brand name, company name, domain name, product names, or similar terms in search engine advertising;
  • not to publish advertisements that create the impression that they originate from or are authorised by yooy;
  • not to direct paid advertising traffic directly to the yooy website or app;
  • not to use www.yooy.design or similar domains as the visible display URL in advertisements; and
  • not to divert or intercept yooy’s organic or paid traffic through their own advertising activities.

Paid advertising promoting the Creator’s own content (such as blog posts, videos, or social media content) is permitted, provided it complies with these Terms and Conditions.

10. Consequences of Violations

If a Creator breaches these Terms and Conditions, yooy shall be entitled to:

  • suspend the Creator account;
  • remove the Creator from the program with immediate effect;
  • withhold outstanding commission payments in whole or in part; and/or
  • reclaim commissions already paid where such commissions were generated in breach of these Terms and Conditions.

Any further legal rights or remedies available to yooy shall remain unaffected.

11. Final Provisions

These Terms and Conditions shall be governed by the laws of Austria.

The place of jurisdiction shall be Vienna, Austria, to the extent permitted by applicable law.

Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
