1. General
MadeForYou Design & Technology GmbH processes your personal data exclusively in accordance with the provisions of the General Data Protection Regulation (hereinafter also referred to as the “GDPR”) and the Austrian Data Protection Act (Datenschutzgesetz, hereinafter also referred to as the “DSG”).
a) Personal Data
The term “personal data” refers to any information relating to an identified or identifiable natural person (“data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
The personal data processed by MadeForYou Design & Technology GmbH includes: personal information such as name, company name, commercial register number, address, date of birth, place of birth, nationality; contact details such as telephone number and email address; electronic communication data and information such as IP addresses, cookies, pixels, apps, etc.; order data relating to purchases; marketing and sales data; general communication data such as customer service inquiries and consultations; data collected by MadeForYou Design & Technology GmbH itself or through partners, such as purchasing behavior, payment behavior, and interests; data required to comply with legal and regulatory obligations; data required to fulfill contractual obligations such as warranty claims; credit card data solely for fraud prevention purposes; and other bank account details solely for the purpose of processing refunds.
A customer account can be created via the website and the app. A distinction is made between “End Customers” and “Business Customers (Opticians).” Depending on the customer type, the following data is processed:
• Name, Billing address, shipping address, email address, additional contact details, order history
For Business Customers, the following additional data is processed: Company name, commercial register number, activation status, VAT identification number
When registering via the website, this data is stored directly in Shopify. When registering via the app, the data is securely transmitted to Shopify.
Account and registration data is stored until the customer account is deleted.
To enable the individual customization of eyeglass frames, the app provides a function for recording facial measurements (e.g., face width, face height, nose width). This data:
• is processed exclusively locally on the user’s device;
• is not transmitted to any servers; and
• is automatically deleted when the app is closed without saving the design.
The facial and measurement data collected within the app is used exclusively for local, anonymous measurement purposes to customize eyeglass frames. No biometric identification or unique identification of an individual takes place. Processing is carried out exclusively on the user’s device without transmission to any servers.
When a design is saved, these measurement values are stored within the design file so that they can be reused for future editing. Users are responsible for ensuring that no personal identifiers (e.g., customer names) are included in the file name.
Designs can be deleted locally at any time. No automatic or server-side storage takes place.
b) Purpose of Processing
MadeForYou Design & Technology GmbH processes only such personal data (hereinafter also referred to as “data”) as is necessary for the performance of a contract (Article 6(1)(b) GDPR), data voluntarily provided by you (Article 6(1)(a) GDPR) for which you have granted your consent for the respective purpose, data required for the purposes of the legitimate interests pursued by MadeForYou Design & Technology GmbH or by a third party (Article 6(1)(f) GDPR), or where processing is based on another legal basis.
The following legitimate interests are pursued by MadeForYou Design & Technology GmbH or by third parties in the processing of your personal data:
Carrying out marketing activities, in particular personalized advertising in cooperation with third parties, such as advertising partners; operating customer loyalty programs; providing customer accounts and customer profiles on the MadeForYou Design & Technology GmbH website; processing and storing the content of communications by email, telephone, or other means of communication (e.g., complaints or requests for information); analyzing purchasing behavior together with advertising partners; enforcing legal claims and defending against unjustified claims; fraud prevention and detection measures, such as preventing credit card fraud; consulting credit agencies and exchanging data for creditworthiness assessments; measures to further develop products and services; statistical evaluations; coordination, business development, and strategic measures within MadeForYou Design & Technology GmbH.
The marketing, analytics, and tracking measures described in this section (in particular personalized advertising, Google Analytics, Google Ads, and Meta Pixel) are used exclusively in connection with the website www.yooy.design and are not used within the “yooy” mobile application.
You have the right to object, on grounds relating to your particular situation, to processing based on legitimate interests pursuant to Article 21 GDPR.
c) Access to Your Data
MadeForYou Design & Technology GmbH has implemented appropriate technical and organizational measures to ensure that no unauthorized access to data or unlawful use of data can occur. All data is transmitted using SSL encryption and, where technically possible, stored within the European Union. Access is granted only to authorized persons. These technical and organizational measures are continuously evaluated and adapted to current technical standards.
Employees of MadeForYou Design & Technology GmbH are contractually obligated to maintain data confidentiality pursuant to Section 6(1) of the Austrian Data Protection Act (DSG). Only those employees who require access to your data in order to fulfill the respective purposes are granted access.
MadeForYou Design & Technology GmbH engages data processors for the processing of your data and has concluded the necessary data processing agreements with them in accordance with Article 28 GDPR. Data processors are companies that support MadeForYou Design & Technology GmbH in achieving its business objectives and performing its business activities, such as IT service providers, payment providers, suppliers, shipping companies, printing companies, tax advisors, and similar service providers. These data processors receive your data only to the extent necessary for the performance of their assigned tasks.
Third parties with whom MadeForYou Design & Technology GmbH cooperates for the processing purposes described above, or who have a legitimate interest within the scope of such cooperation, such as debt collection agencies, payment providers (Shopify), online marketplaces, or shipping service providers, may also receive personal data from MadeForYou Design & Technology GmbH, for example if you purchase products through such platforms.
Ordering eyeglass frames is possible exclusively through the app. For this purpose, the following data is transmitted to Shopify:
Internal customer number, Configuration code and end customer identifier (e.g., customer name or customer number) for the issuance of the MDR Certificate of Conformity, which is also engraved on the temple of the eyeglass frame.
All order data is retained for seven (7) years in accordance with Austrian tax law requirements.
Where required by law or by an official authority, personal data may also be disclosed to public authorities.
Personal data will only be transferred to countries outside the European Union where the respective country ensures an adequate level of data protection pursuant to Article 45 GDPR or where other appropriate safeguards pursuant to Article 46 GDPR ensure an adequate level of protection.
d) Storage of Personal Data
The storage period for your personal data depends on the legal basis and purpose of the processing. Where processing is necessary for the performance of a contract, the data will be stored until the contractual relationship has ended. Where processing is based on your consent, the data will be stored until you withdraw your consent. Where processing is based on the legitimate interests of MadeForYou Design & Technology GmbH or a third party, the data will be stored until such legitimate interests cease to exist. In addition, data may be stored for as long as statutory retention obligations or reporting obligations exist, particularly under the Austrian Commercial Code (UGB) and the Austrian Federal Fiscal Code (BAO), or for as long as legal claims arising from contractual relationships may be asserted against MadeForYou Design & Technology GmbH.
For the purpose of enforcing or defending warranty claims and claims for damages, storage for a period of three (3) years (short limitation period) up to thirty (30) years in individual cases (long limitation period) may be necessary.

5. Required Provision of Data
In order to process your order, we require certain personal data from you. If you provide us with personal data, you are obliged to ensure that the information provided is accurate and truthful. In the event of incorrect information, including false statements regarding your age, we reserve the right to claim compensation for any resulting damages and, where criminal offences are involved, to report the matter to the competent authorities.
You are not obliged to provide personal data or to consent to its processing where such data is not necessary for the performance of the contract.
However, due to differing legal age requirements regarding consent and legal capacity, we may need to request your age in individual cases.
6. Automated Decision-Making and Profiling
MadeForYou Design & Technology GmbH does not use automated decision-making.
MadeForYou Design & Technology GmbH aims to take your personal interests, preferences, and purchasing behavior into account in order to provide you with an optimal shopping experience in our mobile app, online store, and retail stores. MadeForYou Design & Technology GmbH uses Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, and Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).
On behalf of MadeForYou Design & Technology GmbH, Google processes usage data and device information to evaluate the use of the website and to compile reports on website activity. Cookies and similar technologies are used for this purpose. The resulting statistics enable MadeForYou Design & Technology GmbH to improve its services and make them more attractive for users. This website also uses Google Analytics for cross-device analysis of visitor activity by means of a User ID.
If you have a Google user account, you can disable cross-device analysis of your usage in your account settings under “My Data” and “Personal Information.”
Please note that Google Analytics has been extended on this website by the code ”_anonymizeIp();” to ensure that IP addresses are collected in abbreviated form. Google Ads uses cookies to display advertisements that are relevant to users, improve campaign performance reporting, and prevent users from seeing the same advertisement multiple times. In addition, Google Ads can use cookie IDs to record so-called conversions related to advertising requests. This occurs, for example, when a user views a Google Ads advertisement and later visits the advertiser’s website using the same browser and completes a purchase.
Search Ads 360 processes user data obtained from Google Analytics in real time in order to display advertisements based on your presumed interests.
Google’s Remarketing function enables Google to recognize users when they visit websites that are part of Google’s advertising network. On these websites, users may be shown advertisements relating to content they previously viewed on websites using Google’s Remarketing functionality.

MadeForYou Design & Technology GmbH uses the Facebook Pixel to analyze website visitors and evaluate them for the purpose of displaying targeted Facebook advertisements.
The “yooy” mobile application additionally uses the Meta SDK solely for the technical measurement of app installations and general app usage events. The data collected is used exclusively for anonymized statistical analysis and the measurement of advertising campaign performance.

This Privacy Policy may be amended whenever necessary. The current version is available at any time within the mobile application and on the website.
